1. Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen gelten für alle Verträge über Lieferungen und Leistungen von Sarah Stange Fotografie, insbesondere für den Erwerb von Fotografien, digitalen Bilddateien und Fotoprodukten über den von Sarah Stange Fotografie bereitgestellten Online-Shop.

Abweichende Bedingungen des Kunden gelten nur, wenn ihrer Geltung ausdrücklich zugestimmt wurde.

2. Angebot und Vertragsschluss
Die Darstellung von Fotografien, digitalen Bilddateien und Fotoprodukten im Online-Shop stellt kein verbindliches Angebot zum Abschluss eines Kaufvertrages dar.

Der Kunde kann die gewünschten Produkte auswählen und über den vorgesehenen Bestellvorgang eine verbindliche Bestellung abgeben.

Der Vertrag kommt nach Maßgabe des im Online-Shop dargestellten Bestellprozesses und der entsprechenden Bestell- bzw. Auftragsbestätigung zustande.

Eine bloße automatisierte Eingangsbestätigung stellt nur dann bereits eine Annahme der Bestellung dar, wenn dies im Bestellprozess ausdrücklich so ausgewiesen wird.

3. Widerrufsrecht
Verbrauchern steht bei Fernabsatzverträgen grundsätzlich das gesetzliche Widerrufsrecht zu, soweit keine gesetzliche Ausnahme besteht oder das Widerrufsrecht nach den gesetzlichen Vorschriften erloschen ist.

3.1 Individuell hergestellte Fotoprodukte
Ein Widerrufsrecht besteht gemäß § 312g Abs. 2 Nr. 1 BGB insbesondere nicht bei Verträgen über Waren, die nicht vorgefertigt sind und für deren Herstellung eine individuelle Auswahl oder Bestimmung durch den Kunden maßgeblich ist oder die eindeutig auf die persönlichen Bedürfnisse des Kunden zugeschnitten sind.

Dies betrifft insbesondere Fotoprodukte, die individuell anhand der vom Kunden ausgewählten Fotografien hergestellt werden.

3.2 Digitale Bilddateien
Für digitale Inhalte, die nicht auf einem körperlichen Datenträger bereitgestellt werden, gelten die gesetzlichen Bestimmungen über das Widerrufsrecht.

Bei kostenpflichtigen digitalen Inhalten kann das Widerrufsrecht vor Ablauf der gesetzlichen Widerrufsfrist erlöschen, wenn die hierfür gesetzlich vorgeschriebenen Voraussetzungen erfüllt sind, insbesondere wenn der Verbraucher ausdrücklich dem Beginn der Vertragserfüllung vor Ablauf der Widerrufsfrist zugestimmt und bestätigt hat, dass er hierdurch sein Widerrufsrecht verliert.

Im Übrigen gelten die im jeweiligen Bestellprozess bereitgestellten Informationen und die gesetzliche Widerrufsbelehrung.

4. Preise, Versandkosten und Zahlung
Es gelten die zum Zeitpunkt der Bestellung im Online-Shop angegebenen Preise.

Etwaige Versandkosten und sonstige Zusatzkosten werden dem Kunden vor Abgabe seiner Bestellung angezeigt.

Die verfügbaren Zahlungsarten und Zahlungsbedingungen werden im jeweiligen Bestellprozess angezeigt.

Bei Zahlungsverzug gelten die gesetzlichen Bestimmungen.

5. Zahlungsabwicklung
Zur technischen Abwicklung des Online-Shops und der Bestellungen wird die Plattform fotograf.de der Fotografen Online Service GmbH (FOS) eingesetzt.

Die Zahlungsabwicklung kann über die Fotografen Online Service GmbH bzw. über die im Bestellprozess angebotenen Zahlungsdienstleister erfolgen.

6. Lieferung und Bereitstellung
Die jeweils verfügbaren Lieferarten, Lieferzeiten und gegebenenfalls anfallenden Versandkosten werden im Online-Shop angezeigt.

Digitale Bilddateien werden in der im jeweiligen Bestellprozess angegebenen Form, insbesondere als Download, bereitgestellt.

Der Kunde ist dafür verantwortlich, erworbene digitale Bilddateien nach der Bereitstellung auf einem eigenen geeigneten Speichermedium dauerhaft zu sichern.

Eine zeitlich unbegrenzte Speicherung oder erneute Bereitstellung digitaler Bilddateien ist nicht geschuldet, sofern nicht ausdrücklich etwas anderes vereinbart wurde.

7. Eigentumsvorbehalt
Gelieferte körperliche Waren bleiben bis zur vollständigen Bezahlung des Kaufpreises Eigentum von Sarah Stange Fotografie.

8. Urheberrecht und Nutzungsrechte
Die Fotografien sind urheberrechtlich geschützt. Das Urheberrecht verbleibt bei Sarah Stange Fotografie.

Mit dem Erwerb eines körperlichen Fotoproduktes erhält der Kunde das Eigentum an dem jeweiligen Produkt. Eine Übertragung des Urheberrechts ist damit nicht verbunden.

Beim Erwerb einer digitalen Bilddatei erhält der Kunde ein einfaches, zeitlich und räumlich unbeschränktes Nutzungsrecht für private, nicht kommerzielle Zwecke.

Der Kunde darf die erworbenen digitalen Bilddateien für den eigenen privaten Gebrauch speichern, vervielfältigen und privat weitergeben.

Eine Veröffentlichung auf privaten bzw. persönlichen Social-Media-Profilen ist für private, nicht kommerzielle Zwecke gestattet, soweit dadurch keine Rechte Dritter verletzt werden.

Eine gewerbliche Nutzung, Weiterveräußerung, Lizenzierung oder sonstige kommerzielle Verwertung der Fotografien bedarf der vorherigen Zustimmung von Sarah Stange Fotografie.

9. Bildgestaltung und Bearbeitung
Die fotografische Gestaltung und Bearbeitung der Bilder erfolgt im Stil von Sarah Stange Fotografie.

Farbgebung, Bildausschnitt, Helligkeit, Kontrast und sonstige gestalterische Entscheidungen liegen im künstlerischen und fachlichen Ermessen der Fotografin.

Technisch bedingte Abweichungen zwischen der Darstellung eines Bildes auf einem Bildschirm und einem gedruckten Fotoprodukt können insbesondere aufgrund unterschiedlicher Bildschirmdarstellungen, Materialien und Produktionsverfahren auftreten.

Gesetzliche Mängelrechte bleiben hiervon unberührt.

10. Gewährleistung
Für sämtliche Waren, digitalen Produkte und Leistungen gelten die gesetzlichen Mängelrechte.

Bei Produktions-, Liefer- oder sonstigen Mängeln wird der Kunde gebeten, sich möglichst zeitnah an Sarah Stange Fotografie bzw. den im Bestellprozess angegebenen Ansprechpartner zu wenden.

Die gesetzlichen Rechte des Kunden werden durch eine unterlassene Mitteilung nicht eingeschränkt.

11. Haftung
Sarah Stange Fotografie haftet unbeschränkt für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit sowie für Schäden, die auf Vorsatz oder grober Fahrlässigkeit beruhen.

Bei leicht fahrlässiger Verletzung wesentlicher Vertragspflichten ist die Haftung auf den vertragstypischen, bei Vertragsschluss vorhersehbaren Schaden begrenzt.

Wesentliche Vertragspflichten sind solche, deren Erfüllung die ordnungsgemäße Durchführung des Vertrages überhaupt erst ermöglicht und auf deren Einhaltung der Kunde regelmäßig vertrauen darf.

Die Haftung nach zwingenden gesetzlichen Vorschriften bleibt unberührt.

12. Datenschutz
Informationen zur Verarbeitung personenbezogener Daten, insbesondere im Zusammenhang mit der Nutzung von fotograf.de und dem Online-Shop, ergeben sich aus der jeweils aktuellen Datenschutzerklärung von Sarah Stange Fotografie.

13. Rechtswahl und Gerichtsstand
Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts.

Bei Verbrauchern gilt diese Rechtswahl nur insoweit, als ihnen dadurch nicht der Schutz zwingender Vorschriften des Staates ihres gewöhnlichen Aufenthalts entzogen wird.

Für Verbraucher gelten die gesetzlichen Gerichtsstandsregelungen.

Ist der Kunde Kaufmann, eine juristische Person des öffentlichen Rechts oder ein öffentlich-rechtliches Sondervermögen, gelten die gesetzlichen Bestimmungen über zulässige Gerichtsstandsvereinbarungen.

14. Schlussbestimmungen
Sollten einzelne Bestimmungen dieser Allgemeinen Geschäftsbedingungen ganz oder teilweise unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen hiervon unberührt.

An die Stelle unwirksamer Bestimmungen treten die gesetzlichen Regelungen.

1. Scope
These General Terms and Conditions apply to all contracts for deliveries and services provided by:

They apply in particular to the purchase of photographs, digital image files and photo products via the online shop provided by Sarah Stange Fotografie.

Any terms and conditions of the Customer that deviate from these General Terms and Conditions shall only apply if their applicability has been expressly agreed.

2. Offers and Conclusion of Contract
The presentation of photographs, digital image files and photo products in the online shop does not constitute a binding offer to conclude a purchase contract.

The Customer may select the desired photographs and products and submit a binding order using the designated ordering process.

The contract is concluded in accordance with the ordering process displayed in the online shop and the corresponding order or order confirmation.

An automatically generated acknowledgement of receipt shall only constitute acceptance of the order if this is expressly indicated during the respective ordering process.

3. Right of Withdrawal
Consumers generally have the statutory right of withdrawal in the case of distance contracts unless a statutory exception applies or the right of withdrawal has expired in accordance with applicable law.

3.1 Individually Produced Photo Products
Pursuant to Section 312g (2) No. 1 of the German Civil Code (BGB), there is no right of withdrawal in particular for contracts concerning goods that are not prefabricated and for the production of which an individual choice or decision by the Customer is decisive, or which are clearly tailored to the Customer's personal requirements.

This applies in particular to photo products that are individually produced using photographs selected by the Customer.

3.2 Digital Image Files
The statutory provisions governing the right of withdrawal apply to digital content that is not supplied on a tangible medium.

For paid digital content, the right of withdrawal may expire before the end of the statutory withdrawal period if the legally prescribed requirements are met. In particular, this requires the Consumer to have expressly consented to performance of the contract beginning before the end of the withdrawal period and to have acknowledged that, by giving such consent, the Consumer loses the right of withdrawal.

In all other respects, the information provided during the respective ordering process and the statutory information concerning the right of withdrawal shall apply.

4. Prices, Shipping Costs and Payment
The prices displayed in the online shop at the time the order is placed shall apply.

Any shipping charges and other additional costs will be displayed to the Customer before the order is submitted.

The available payment methods and payment terms are displayed during the respective ordering process.

In the event of late payment, the applicable statutory provisions shall apply.

5. Payment Processing
The fotograf.de platform operated by Fotografen Online Service GmbH (FOS) is used for the technical operation of the online shop and the processing of orders.

Payments may be processed by Fotografen Online Service GmbH and/or by the payment service providers offered during the respective ordering process.

6. Delivery and Provision of Digital Content
The available delivery methods, delivery times and any applicable shipping charges are displayed in the online shop.

Digital image files are provided in the form specified during the respective ordering process, in particular as a download.

The Customer is responsible for permanently backing up purchased digital image files on a suitable personal storage medium after they have been made available.

Unless expressly agreed otherwise, there is no entitlement to indefinite storage or renewed provision of digital image files.

7. Retention of Title
Physical goods supplied remain the property of Sarah Stange Fotografie until the respective purchase price has been paid in full.

8. Copyright and Rights of Use
All photographs are protected by copyright. Copyright remains with Sarah Stange Fotografie.

The purchase of a physical photo product transfers ownership of the respective physical product to the Customer. Copyright is not transferred.

When purchasing a digital image file, the Customer is granted a non-exclusive right of use, unlimited in time and territory, for private, non-commercial purposes.

The Customer may store, reproduce and privately share purchased digital image files for their own private use.

Publication on private or personal social media profiles for private, non-commercial purposes is permitted, provided that no third-party rights are infringed.

Commercial use, resale, licensing or any other commercial exploitation of the photographs requires the prior consent of Sarah Stange Fotografie.

9. Image Design and Editing
The photographic design and editing of the images is carried out in accordance with the photographic style of Sarah Stange Fotografie.

Colour grading, cropping, brightness, contrast and other creative decisions are at the artistic and professional discretion of the Photographer.

Technical differences between the appearance of an image on a screen and the appearance of a printed photo product may occur due to differences in screen displays, materials and production processes.

Statutory rights relating to defects remain unaffected.

10. Warranty
The statutory rights relating to defects apply to all goods, digital products and services.

In the event of production, delivery or other defects, the Customer is requested to contact Sarah Stange Fotografie or the contact person specified during the ordering process as soon as reasonably possible.

Failure to provide such notification shall not restrict the statutory rights of Consumers.

11. Liability
Sarah Stange Fotografie shall be liable without limitation for damages resulting from injury to life, body or health and for damages caused intentionally or through gross negligence.

In the event of a slightly negligent breach of an essential contractual obligation, liability shall be limited to the foreseeable damage typical for the contract at the time the contract was concluded.

Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment the Customer may regularly rely.

Liability under mandatory statutory provisions remains unaffected.

12. Data Protection
Information concerning the processing of personal data, in particular in connection with the use of fotograf.de and the online shop, can be found in the current Privacy Policy of Sarah Stange Fotografie.

13. Applicable Law and Jurisdiction
The law of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

In the case of Consumers, this choice of law applies only insofar as it does not deprive the Consumer of the protection afforded by mandatory provisions of the law of the country in which the Consumer has their habitual residence.

The statutory rules on jurisdiction apply to Consumers.

Where the Customer is a merchant, a legal entity under public law or a special fund under public law, the statutory provisions concerning permissible jurisdiction agreements shall apply.

14. Final Provisions
Should any individual provision of these General Terms and Conditions be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

The applicable statutory provisions shall apply in place of any invalid or unenforceable provision.
